All models, actors, actresses and other persons that appear in any image or video, whether of actual or simulated sexual activity or otherwise, that appears on the website were over the age of eighteen years at the time of the creation of such.

Exemption: Content Produced by Third Parties

The operator of grannytube.net is not the primary "producer" of any depictions of explicit sexual or simulated sexual behavior that may be displayed there. In the case of content supplied by third-party users of the website, whether explicitly sexual in nature or otherwise, the operators and owners of grannytube.net confine their undertakings to the transmission, storage, retrieval, hosting and/or formatting of that content. All content that is supplied by third-party users is displayed on areas of grannytube.net which are under the control of those users. Hence, the website operators and owners are absolved from compliance with Section 2257 records keeping and labeling obligations as given in 28 C.F.R. §75.1(c)(4). Any content that is held to be illegal, obscene, harmful, harassing, defamatory or in any respect antithetical to the terms of use and policies of the website, may be removed as decided solely by the operator or owner, in accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

Exemption: Content Produced by Website Operator

Any visual depictions that may appear on the website, for which the operator of the website may be held to be the “producer,” are not subject to the provisos of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not include any sexually explicit activity as laid out in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not include depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not include simulated sexually explicit behavior; or (4) the images or videos were shot before July 3, 1995.
